Introduction


Almond Life, Inc. and its affiliates including Almond Life P.C. (“Almond”, “we”, “us”) have created this privacy policy (“Privacy Policy”) in order to set out how we collect, use, and disclose personal information through our website located at www.almondobgyn.com (the “Website”) that is offered as part of Almond’s obstetrics and gynecology telehealth services. This Privacy Policy applies to all of the products, services, and websites offered by Almond or our related, affiliated and/or subsidiary companies (collectively the “Services”). 

By visiting our Website and/or using the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and you hereby consent to the collection, use and disclosure of your Personal Information in accordance with this Privacy Policy.


What does this privacy policy cover?


This Privacy Policy covers our collection, use and disclosure of information about identifiable individuals and information which can be used to identify an individual (“Personal Information”). Personal Information does not include “aggregate” information which we aggregate from information (including Personal Information) you provide to us. Personal Information may be collected about our patients, prospective patients, visitors to the Website, and end users of the Services. You can choose not to provide us with certain information, but by doing so, you may not be able to take advantage of many of the features and functionality of our Services.


Supplemental Notices. We may provide additional privacy notices to individuals at the time we collect their Personal Information. These additional privacy notices may supplement this Privacy Policy or may apply in lieu of this Privacy Policy. 


Notice Regarding Customer Data. In some cases, a customer or affiliated professional corporation may enter into a written agreement with us where we process Personal Information and/or Protected Health Information on their behalf (“Customer Data”). This Privacy Policy may not apply to Customer Data. The customer’s or affiliated professional corporation’s respective privacy policy and/or notice of privacy practices governs their collection and use of Customer Data. Our processing of Customer Data is governed by the contracts that we have in place with the customer or affiliated professional corporation, not this Privacy Policy. Any questions or requests relating to Customer Data should be directed to our customer or affiliated professional corporation.


HIPAA Notice of Privacy Practices. This Privacy Policy does not apply to our covered entity, Almond Life, P.C.’s processing of “Protected Health Information” under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). Where we act as a covered entity, Almond Life, P.C.’s processing of “Protected Health Information” is governed by our HIPAA Notice of Privacy Practices.


Almond makes no representation and assumes no responsibility for the accuracy of information contained on or available through this web site, and such information is subject to change without notice. Collection of Personal Information 


Almond collects Personal Information in the following general ways:

  • Almond collects Personal Information you knowingly choose to submit to us through the Services, such as your name and email address. 
  • When you access or use the Services, Almond may automatically receive and record information on our server logs from your browser, including your IP address, cookies, and the pages you request. IP addresses are automatically reported by your browser each time you view a web page. Your IP address is stored by Almond when you register with Almond.
  • Through third parties. 

Personal Information You Provide to Us 

 Account Information:  In order to use the Services, users may be required to have a valid Almond account to log in to the Website (an “Account”). When you register for the Services, Almond collects your name, email address, birth date, gender, zip code, your business phone number and business address (“Account Information”). Almond will also have access to information about your use of the Services such as medical appointments made, test results, geo-location data and other information available that is combined with your Account Information. 


Health Information: In providing Services to you, we may collect Personal Information that relates to your health or medical treatment that you have received. This may include, but is not limited to, information about medical history, information about your diet and wellness activities, and insurance information.


Virtual Video Visits – Telehealth: If we connect you with a medical professional via a virtual visit, you will need to provide access to your camera and microphone. We and others with whom you video chat (e.g., the medical professional) may collect the content and information you make available. 


Purchases: We may collect Personal Information and details associated with your purchases, including payment information. Any payments made via our Services with a credit or debit card are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our Services, but we may receive information associated with your payment card information (e.g., your billing details).


Your Communications with Us: We may collect Personal Information, such as email address, phone number, or mailing address when you request information about our Services, register for our newsletter, request customer or technical support, or otherwise communicate with us.


Surveys: We may contact you to participate in surveys. If you decide to participate, we may collect Personal Information from you in connection with the survey.


Interactive Features: We and others who use our Services may collect Personal Information that you submit or make available through our interactive features (e.g., messaging, chat, and telehealth features, commenting functionalities, forums, blogs, and social media pages). Referrals and Sharing Features: Our Services may offer various tools and functionalities that allow you to provide Personal Information about your friends through our referral service. Our referral services may also allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use our Services. Storage and Transfer of Personal Information


These Services are intended for use by users in the United States. Your information, including Personal Data, may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. Almond processes and stores its data, including Personal Information, on cloud servers located in North America and transfers data to the third-party service providers described herein.


By submitting Personal Information or otherwise using the Services, you agree to this transfer, storing or processing of your Personal Information in the USA. You acknowledge and agree that your Personal Information may be accessible to law enforcement and governmental agencies in the United States under lawful access regimes or court order.


Disclosure of Personal Information to Third Parties

We disclose your Personal Information to third parties for a variety of business purposes, including to provide our Services, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below. 


Physicians and Medical Providers: Our Services may allow you to share your Personal Information or interact with a physician or medical provider. Additional information regarding such sharing is provided in our HIPAA Notice of Privacy Practices


Service Providers and Business Partners:  We may from time to time employ third parties to perform tasks on our behalf and we may need to share Account Information and other Personal Information with them to provide certain services. Unless we tell you differently, such third parties do not have any right to use the Personal Information we share with them beyond what is necessary for them to provide the tasks and services on our behalf. We currently engage third party companies and individuals employed by us to facilitate our Services, including the provision of maintenance services, database management, Web analytics and general improvement of the Services, and businesses who engage our Services (to the extent provided for above).


Business Transfers:  If our business (or substantially all of our assets) are acquired by a third party, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information may be made available or otherwise transferred to the new controlling entity, where permitted under applicable law.


With Your Consent:  If we need to use or disclose any Personal Information including Protected Health Information in a way not identified in this Privacy Policy, we will notify you and/or obtain consent as required under applicable privacy laws.

Retention

We will keep Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. Unless otherwise set forth in the applicable Terms of Service or a separate agreement with you governing the applicable Services, if you cease using such Service, we may retain or destroy, at our discretion, all Personal Information and non-personally identifiable information we collect through your use of such Service. Minors

Almond does not knowingly solicit or collect data from children nor knowingly market to anyone under the age of 13. If you are under the age of 13, you are explicitly not authorized to use this Service. If we become aware that a child under 18 has provided us with Personal Information, we will take reasonable steps to remove such information from our systems and terminate the applicable account.
